By creating an account and using Happy Ending, you agree to these terms. Please read them — they're short and written in plain English.
1. The Service
Happy Ending is a digital legacy platform. It lets you record personal video messages and designate recipients who will receive them when a trigger event occurs — such as the passing of the sender, a missed heartbeat subscription, or a pre-set date.
The core service runs on a $1/month heartbeat subscription. Your subscription is proof that you're still here. If payment lapses for two weeks without a response, we contact your trusted contact to verify your status. If they confirm you've passed, your messages are delivered. If you're fine, we send you a gentle reminder to renew.
2. Eligibility
You must be at least 18 years old to use Happy Ending. By creating an account, you represent that you meet this requirement. We reserve the right to terminate accounts belonging to minors upon discovery.
3. Your Account
- You are responsible for maintaining the security of your account credentials
- You must provide accurate information when signing up
- You may only create one account per person
- You are responsible for all activity that occurs under your account
- Notify us immediately at hello@happyending.cool if you suspect unauthorized access
4. Subscription & Billing
Happy Ending offers the following subscription plans:
- Heartbeat — $1/month. Up to 3 video messages, up to 5 recipients
- Memories — paid monthly. Unlimited messages and recipients
- Forever — one-time payment. Unlimited messages and recipients, perpetual storage
Subscriptions are billed via Stripe. You may cancel at any time from your account settings. Cancellation stops future billing but does not entitle you to a refund of amounts already charged. We do not offer partial-month refunds.
We reserve the right to change pricing with at least 30 days' notice. You'll receive an email before any price change takes effect.
5. Message Delivery
We will make commercially reasonable efforts to deliver your messages when a trigger event occurs. However, we cannot guarantee delivery in all circumstances, including:
- Recipient email address is no longer valid or bouncing
- Recipient's email provider blocks or marks delivery email as spam
- Service interruption or force majeure event
We recommend keeping recipient contact information up to date and informing recipients that they may receive a message from Happy Ending in the future.
We will never deliver your messages early or to anyone other than the recipients you designate, except as required by law.
6. Content Guidelines
You are responsible for the content of your messages. By uploading content to Happy Ending, you confirm that your content:
- Does not contain illegal material of any kind
- Does not contain child sexual abuse material (CSAM) — accounts containing CSAM will be immediately reported to law enforcement
- Does not threaten, harass, or incite violence against any individual or group
- Does not infringe on the intellectual property rights of any third party
- Does not contain content designed to defraud your recipients
We reserve the right to remove content that violates these guidelines and to terminate accounts responsible for such content, without refund.
7. Intellectual Property
You retain full ownership of the video messages and content you create. By uploading content, you grant Happy Ending a limited license to store, process, and deliver it as necessary to operate the service. We do not claim any ownership over your content.
The Happy Ending name, logo, and product design are our intellectual property. You may not use them without our written permission.
8. Privacy
How we collect, use, and protect your data is described in our Privacy Policy, which is incorporated into these Terms by reference.
9. Disclaimer of Warranties
Happy Ending is provided "as is" and "as available", without warranty of any kind. We do not warrant that the service will be uninterrupted, error-free, or that messages will be delivered in all circumstances.
We are an early-stage product. Things break. We'll do our best to fix them quickly and be transparent when they do.
10. Limitation of Liability
To the maximum extent permitted by law, Happy Ending shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service — including, but not limited to, failure to deliver messages, loss of data, or service interruptions.
Our total liability to you for any claim arising out of these Terms or your use of the service shall not exceed the total amount you paid us in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Happy Ending and its operators from any claims, damages, or expenses arising from your use of the service, your content, or your violation of these Terms.
12. Termination
You may close your account at any time from your dashboard settings. Your messages will be permanently deleted within 30 days.
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the service in a way that harms other users or our infrastructure. We'll give you advance notice where possible.
If your subscription lapses and your trusted contact confirms you've passed away, your account will transition to a delivery-complete state and new messages cannot be added.
13. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Delaware.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via email at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance of the updated Terms.
